I would vote for Unofficial Illegal 4th.
Unofficial, since it is not the official 4th that was released.
Illegal, since the deal with USPCC was probably supposed to have all cards destroyed, and if that was the case, the selling of these cards is probably illegal, WOTC just is not enforcing it - yet.

That's because it was their mistake back then, this time it's another company which has been legally bound to destroy them but obviously hasn't. If you thought about it for just a second you'd see there's quite a big difference.
I still doubt they're going to do anything about it, why waste money on something small like this with all the current counterfeiters out there? But it's definately not the same thing as the summer incident.

Some of this product might have gotten out before the deal was severed, and before the product was ordered destroyed. This may have contributed to the rift between Wizards and USPCC.
Unless more alt-fourth product has been stockpiled by USPCC, and is being added to the market, then Wizards doesn't mind the circuation of existing alt-fourth product at all.
From a practical standpoint, there is little they can do. They might offer a recall / trade in, but will you send them alt-fourth cards to be replacemed by core set boosters or singles? The best they could "legaly" do is stop USPCC from issuing more product, which apparantly happened many years ago.
From a market standpoint, anything that increases interest in existing collections of magic cards will have a positive impact on short term sales of new cards. Since that helps Hasbro, they aren't going to try and stop it.

Exactly what I meant, Muldoon - the situation is different, but Wizards still has no reason to spend the money/effort to thwart collectors.

Not to mention that these weren't really noticed until 2 or 3 versions of the basic set after the fact, and the actual source wasn't discovered until recently. I'm going to go out on a limb and guess that there's a statute of limitations on this kind of thing, being that the sales all happened when 4th was the latest version of the base set (and the sales were carried out not by representatives of the company but by employees who had walked off with product)

How bout we call it the not so rare version of 4th edition that Star City is trying to gouge buyers with outrageous prices by calling it some version of Summer Magic which it really isn't!
